Sole proprietorship FAQ


Like other entrepreneurs, you can deduct all business expenses from your income to determine your profits. These include work equipment, telephone and internet, the company car and travel expenses as well as the rent for your office and all other expenses that you have to incur for carrying out your business. Sole traders can operate as small entrepreneurs if they do not exceed a certain level of turnover each year. If you have opted for the small business regulation, however, you cannot claim input tax from the tax office.
Solo self-employed people often do not have a lot of capital available when they start up and therefore often do not choose a GmbH as their legal form. Sole proprietorships are also much quicker and less bureaucratic to set up, and accounting is also less complicated with the simple income-expenditure statement. Since a GmbH often has several shareholders, a sole proprietor is much more self-determined in comparison and can book the entire profit for himself.
A sole proprietorship only has to be entered in the commercial register if it is a commercial enterprise. For small traders, entry in the commercial register is voluntary and only makes sense in the rarest of cases. Freelancers are not entered in the commercial register.
From a legal point of view, a firm is only the trade name of a business. Whether one is allowed to establish a company in Germany depends on the circumstances of the individual case. There are certain activities that require a permit or for which one needs certain qualifications. A person can only become the managing director of a limited liability company if he or she does not have a criminal record for economic offences. This must be checked in each individual case.
