The list of goods and services in trademark law should contain all those goods and services that are to be offered and protected under your trademark. All goods and services are divided into a total of 45 classes (34 classes of goods and 11 classes of services) of the so-called Nice Classification.
A trademark cannot be filed and protected in general, but only for goods and services designated and specified by the trademark applicant. Therefore, when filing the trademark application, the goods and services for which the trademark is to be protected must be specified.
On the one hand, a subsequent extension of the list of goods and services is not possible. Secondly, the choice of the wrong goods and services can lead to the trademark not being used in fact, since other goods and services than those indicated are offered for sale under it. In the worst case, this leads to cancellation of the trademark and to the fact that the goods and services actually offered do not fall under the protection of the trademark, since the trademark was not registered for this purpose.
The Harmonised Database is a collection of individual, concrete goods and services which have already been examined by the trademark offices and checked for their distinctiveness and correct classification. The recourse to these terms provides the applicant with the certainty that the list of goods and services itself will not be objected to by the Office during examination. At the same time, it enables accelerated examination and faster registration. On the other hand, in case of high specialisation of goods or services, it makes sense to deviate from the given terms.
In addition to a basic fee, the official fees due upon filing a trademark application are further calculated according to the number of classes of goods and services designated by the application. The more classes are designated, the higher the fees to be paid. However, the number of goods or services designated in a class does not increase the fees.
