Does the GDPR apply to my app?
Yes, it does! Every app that is offered for purchase or download in the German or European app store is already subject to the territorial scope of the GDPR, regardless of where the app provider is based.
Mobile applications, apps, are not a legal vacuum!
The download of apps follows the rules of sales law - with the right to complain about errors and with the special feature of the possibility of withdrawal. Accordingly, legal information obligations must be respected here in the same way as with a website. In particular, apps from dubious sources can be a gateway for malware on your mobile device. This raises questions of data protection and liability.
What must the app provider observe?
The app provider must observe the requirements specified in the GDPR. This is based on the data protection principles laid down in Article 5 of the GDPR, which must always be taken into account and for any data processing: "lawfulness", "purpose limitation", "data minimisation", "accuracy", "storage limitation" and "integrity and confidentiality".
