You want to register a trademark and ensure that it does not infringe on existing trademarks or distinctive signs? During our 2-hour coaching, we will make you fit to carry out a collision check in the commercial register and the trademark register by yourself! We will show you what to focus on during the search, where to look for trademarks or distinctive signs and answer all your questions about the topic of collision checks/conflict checks.
Identity research
Within the scope of the identity search, we offer a trademark search for already applied for, published or registered trademarks identical in wording. The search includes German trademarks, trademarks in the other member states of the European Union, Union trademarks (trademark with validity for the entire EU) as well as international trademark registrations with extension to the EU or one of its member states. In addition, we check the German commercial register for you for registered, identical company trademarks.
At the end you will receive a search report.
The hourly quota for this is 1 hour. If we need more time for the search, we will coordinate this with you individually and offer further processing at an hourly rate of 150.00 € net.

What is a conflict check under trademark and trademark law?
During a conflict check, we scan the trademark registers, but also other public registers such as the German commercial register, to find out whether the trademark you want to file or use yourself is already in use or is registered and thus protected.
Why should I carry out or order such a conflict check?
In order to avoid disputes with trademark owners of already existing trademarks and signs, it is advisable to conduct a trademark search (conflict check). If you discover that an identical or similar trademark has already been registered for similar or identical goods and services for which you would like to have your trademark registered yourself, there is a risk of legal disputes, e.g. in the form of an opposition to your own trademark application.
What is an identity search?
During an identity search, the trademark register or other public registers such as the commercial register are only searched for identical, i.e. word-similar trademarks and signs.
What is a similarity search?
In contrast to an identity search, a similarity search not only searches for word- or wording-similar trademarks and distinctive signs in trademark and other public registers such as the German commercial register, but also checks trademarks and distinctive signs that show sufficient similarity to your trademark. This minimises the risk of confusion even further.
Is such a conflict check only useful in the case of a trademark application?
A conflict check with regard to trademark law makes sense especially when registering a trademark in order to avoid confusion and legal disputes with existing trademarks as far as possible. However, an infringement of older trademark and trademark rights can also arise from the fact that you use a company name, for example, which is identical or similar to an already existing trademark or trademark right (sign) and you are active in an identical or similar branch of business. Therefore, a conflict check is also a smart decision for all founding start-ups.
