What is trademark monitoring?
A trademark monitoring is a "screening" of the trademark register or other publicly accessible registers, in which a specific search is made for trademarks or signs that are similar or even identical to your trademark and are simultaneously registered or used in a similar or identical sector or for identical or similar goods and services.
How is the trademark monitoring carried out?
Trademark monitoring takes place at certain intervals over a longer period of time. In the process, trademark registers or other public registers, such as the commercial register in Germany, are searched via online research in order to find and detect any trademarks or signs that could create a likelihood of confusion.
What are the advantages of trademark monitoring?
Through a consistent and regularly recurring trademark monitoring search, identical or confusingly similar trademarks or signs can be quickly detected. As soon as we find such a trademark or sign, we inform you and decide with you which next steps should be taken. If the discovered sign is a trademark in application, there is the possibility to file an opposition against the trademark application. If it is an unregistered sign, you can take action against the further use, e.g. with a warning letter.
