What is a list of goods and services?

The list of goods and services in trademark law should contain all the goods and services that are to be offered and protected under your trademark. All goods and services are divided into a total of 45 classes (34 classes of goods and 11 classes of services) of the so-called Nice Classification.

Why do I need a list of goods and services for a trademark application?

A trademark cannot be registered and protected in the abstract, but only for goods and services designated and specified by the trademark applicant. When applying for a trademark, the goods and services for which the trademark is to be protected must therefore be specified.

Why is it important to be careful when creating the directory?

On the one hand, a subsequent extension of the list of goods and services is not possible. On the other hand, the choice of the wrong goods and services can lead to the trademark not actually being used, as goods and services other than those indicated are marketed under it. In the worst case, this leads to the cancellation of the trademark and to the fact that the goods and services actually offered are not covered by the protection of the trademark, as it was not registered for this purpose.

What is the Harmonised Database?

The Harmonised Database is a collection of individual, specific goods and services that have already been examined by the trademark offices and checked for their uniqueness and correct class classification. The use of these terms provides the applicant with the certainty that the list of goods and services itself will not be objected to by the Office during the examination. At the same time, it enables accelerated checking and faster registration. However, if a product or service is highly specialised, it makes sense to deviate from the predefined terms.

Does the directory affect the application fee?

In addition to a basic fee, the official fees incurred when applying for a trademark are also calculated according to the number of classes of goods and services designated by the application. The more classes are named, the higher the fees to be paid. However, the number of goods or services named in a class does not increase the fee.
